1.0   Definitions

Company’, ‘we’, ‘us’, ‘our’ – means Rose Consulting Ltd.

Client’, ‘you’, ‘your’ – means the person or organisation purchasing the Reinstatement Cost Assessment service.

‘Report’ – means the Reinstatement Cost Assessment (RCA) produced following instruction.

‘Property’ – means the building or buildings which are the subject of the Report.

‘Desktop Assessment’ – means an assessment taken remotely using information provided by the Client and publicly available data.

‘Onsite Assessment’ – means an inspection of the Property carried out by or on behalf of Rose Consulting Ltd.

2.0   Scope of Service

2.1        Rose Consulting Ltd provides Reinstatement Cost Assessments to assist property owners in determining an appropriate insurance rebuild value for buildings.

2.2        The Report is provided for insurance purposes only and should not be relied upon as a market valuation, survey, or structural assessment.

2.3        The assessment will be based on:

  • Information provided by the Client

  • Assumptions stated within the Report

  • Industry cost data and recognised methodologies

  • Professional judgement

2.4        Desktop Assessments rely on information supplied by the Client and available online data. Accuracy of the Report depends on the accuracy and completeness of the information provided.

2.5        Onsite Assessments include a visual inspection of accessible areas of the Property. No intrusive investigations will be undertaken unless otherwise agreed.

3.0   Client Responsibilities

3.1        The Client agrees to provide accurate and complete information relating to the Property, including but not limited to:

  • Property address

  • Floor areas and layout

  • Construction layout

  • Construction type

  • Age of property

  • Details of extensions or alterations

  • Specification level

3.2        Rose Consulting Ltd shall not be responsible for inaccuracies resulting from incorrect or incomplete information supplied by the Client.

3.3        The Client must inform Rose Consulting Ltd of any material changes to the Property that may affect the reinstatement value.

4.0   Limitations of the Report

4.1        The Report is an estimate of rebuilding costs for insurance purposes only.

4.2        The Reports does not include:

  • Market value of the Property

  • Structural condition surveys

  • Identification of defects

  • Compliance with building regulations

  • Legal title checks

  • Planning advice

4.3        The Report assumes the Property will be rebuilt using modern construction methods and materials in compliance with current regulations.

4.4        The reinstatement cost may vary due to market fluctuations, inflation, location factors, or changes in specification.

4.5        The Report does not constitute a guarantee that the sum insured will be sufficient in the event of a claim.

5.0   Use of the Report

5.1        The Report is provided solely for the Client for insurance purposes.

5.2        The Report must not be relied upon by third parties without prior written consent from Rose Consulting Ltd.

5.3        The Client may provide the Report to insurers, brokers or other relevant parties for the purpose of arranging building insurance.

6.0   Fees and Payment

6.1        Fees are payable in advance of the Report being issued unless otherwise agreed in writing.

6.2        The Company reserves the right to suspend or cancel instruction where payment has not been received.

6.3        Fees are inclusive of VAT unless otherwise stated.

7.0   Timescales

7.1        Estimated delivery times are provided for guidance only and are not guaranteed.

7.2        Rose Consulting Ltd shall not be liable for delays caused by:

  • Incomplete of inaccurate information

  • Delays in gaining access to the Property

  • Circumstances beyond our control

8.0   Cancellation and Refunds

8.1        The Client may cancel the instruction prior to work commencing and may be entitled to a refund.

8.2        Where work has already commenced, Rose Consulting Ltd reserves the right to retain a proportion of the fee to cover work undertaken.

8.3        Once the Report has been issued, refunds will not normally be provided.

9.0   Limitation of Liability

9.1        Rose Consulting Ltd.’s liability shall be limited to the fee paid for the service.

9.2        The Company shall not be liable for:

  • Consequential losses

  • Loss of profit

  • Loss arising from inaccurate information provided by the Client

  • Changes in construction costs after the Report date

9.3        Nothing in these terms’ limits liability for death or personal injury caused by negligence.

10.0       Professional Standards

10.1    Services are provided in accordance with recognised industry standards and guidance applicable to reinstatement cost assessments.

10.2    Rose Consulting Ltd maintains appropriate professional indemnity insurance.

11.0       Complaints Procedure

11.1    Complaints will be acknowledged and investigated promptly with our complaint’s procedure.

12.0       Data Protection

12.1    Rose Consulting Ltd processes personal data in accordance with UK GDPR and applicable data protection legislation.

12.2    Information provided will be used solely for the purpose of delivering the requested service.

12.3    Personal data will not be shared with third parties except where necessary to deliver the service or where required by law.

13.0       Intellectual Property

13.1    The Report remains the intellectual property of Rose Consulting Ltd.

13.2    The Client is granted a non-exclusive licence to use the Report for insurance purposes only.

14.0       Governing Law

14.1    These Terms and Conditions shall be governed by the laws of England and Wales.

14.2    Any disputes shall be subject to the exclusive authority of the courts of England and Wales.
